Agreement to Terms

By accessing or using SmartSwaps, operated by CodeSages LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

• Food allergies or intolerances

The nutritional analysis and food swap recommendations provided by SmartSwaps are estimates generated by artificial intelligence and may not be accurate for your specific situation. We do not guarantee the accuracy, completeness, or suitability of any nutritional information provided.

Description of Service

SmartSwaps is a subscription-based nutrition coaching application that uses AI technology to:

• Analyze photos of food to estimate nutritional content
• Suggest healthier food alternatives ("swaps") based on your goals
• Help you find nearby restaurants with suitable menu options
• Track your macro and calorie intake

Subscription and Billing

Subscription Plans

SmartSwaps offers a monthly subscription plan at $9.99 per month. Your subscription will automatically renew each month unless canceled.

Free Trial

New users may be eligible for a free trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless canceled before the trial ends.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial months.

Payment Processing

All payments are processed securely through Stripe. By subscribing, you agree to Stripe's terms of service and authorize us to charge your payment method on a recurring basis.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Provide accurate and complete information when creating your account
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be at least 13 years of age to use this service

Acceptable Use

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Upload content that is harmful, offensive, or infringes on others' rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Use automated methods to access the service without permission
• Resell or redistribute our service without authorization

Intellectual Property

All content, features, and functionality of SmartSwaps, including but not limited to text, graphics, logos, and software, are owned by CodeSages LLC and are protected by copyright, trademark, and other intellectual property laws.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODESAGES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or other intangible losses
• Personal injury or health issues resulting from dietary changes
• Inaccurate nutritional analysis or recommendations
• Service interruptions or technical failures
• Actions taken based on information provided by the service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Disclaimer of Warranties

SMARTSWAPS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITIONAL INFORMATION WILL BE ACCURATE.

Indemnification

You agree to indemnify and hold harmless CodeSages LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the application. Continued use of the service after changes constitutes acceptance of the modified terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
